What is a Grant of Letters of Administration?

With a Grant of Letters of Administration, the applicant can manage the deceased's property, such as distributing assets of the deceased, and it would be illegal for the applicant to do so. 

Applicant's Eligibility

1  |  The deceased did not leave a will. 
2  |  You are a beneficiary: you are entitled to a share of the deceased's assets.
3  |  Your age is 21 years old and above.

When to apply by?

With a Grant of Letters of Administration, the applicant can manage the deceased's property, such as distributing assets of the deceased, and it would be illegal for the applicant to do so. 

How many trips do I need to make to the Service Bureau?

You will need to go to CrimsonLogic Service Bureau at least three (3) times. 

APPLYING FOR GRANT OF LETTERS OF ADMINISTRATION

Without a lawyer, you will have to go to CrimsonLogic Service Bureau to applying for the Grant of Letters of Administration with the relevant documents and application form.

The Schedule of Assets is a list of the deceased assets.

Certified True Copy of Death Certificate

To obtain a true copy, you must bring the death certificate to a notary public.

Renunciation of Other Beneficiaries

You may need copies of other beneficiaries of the deceased's assets giving up their right to apply for the Grant of LOA.

Summary Report of Probate Cases

When submitting your application at the CrimsonLogic Service Bureau, they will conduct a search and obtain a report for you.

Proceed to the CrimsonLogic Service Bureau. What is next?

The Service Bureau will notify you via email or SMS of whether your document is accepted by the court.

Within 14 days of the Court accepting the documents, you will need to: 

Go to the Service Bureau to collect the Schedule of Assets with the Court seal.

Prepare a supplementary affidavit for your Schedule of Assets.

Swear or affirm the Supplementary Affidavit before a Commissioner for Oaths.

Visit the Service Bureau to file the affirmed Supplementary Affidavit.

A supplementary affidavit confirms that the Schedule of Assets is true and accurate.

What is the difference between swearing and affirming?

Whether you swear or affirm depends on your religion:

  • If you are a Christian or a Catholic, you are required to hold the Bible while swearing your affidavit

  • In all other cases, you will make an affirmation instead

The Service Bureau will notify you once again via email or SMS of whether your document is accepted by the court.

IF THE COURT ACCEPTS YOUR DOCUMENTS

The court may approve your application and inform you through a letter not to attend the scheduled hearing.

The letter will also inform you of how to extract the Grant.

How to extract the Grant?

1| Search the court's record of probate cases and caveats filed in     relation to the deceased's estate at the Service Bureau.

If the court does not accept your documents

You will need to attend the scheduled hearing.

2| File the request to extract the Grant on the same day.
